2. Clauses to read carefully
Clause 11 limits our liability, clause 12 lets us suspend or close an account and clause 13 lets us change the portal and these terms. Please read them carefully. If you are a consumer under the Consumer Protection Act, nothing in these terms takes away your rights under that Act.
3. Accepting these terms
By creating an account, accepting an invitation or using the portal, you agree to these terms. If you use the portal for a company or other organisation, you confirm that you may agree to them on its behalf. If you do not agree, do not use the portal.
You can read, print and save these terms at any time at support.globalsoftwareservices.co.za/terms. When you accept an invitation, we record the date and the version you accepted. Ask us if you want a copy of that record.
4. The service
The portal lets our clients and their contacts log and follow support tickets with attachments, see their projects, tasks, meetings and documents, sign contracts electronically and receive notifications. Our products use it for their help pages, enquiry forms and support requests.
The portal is free of charge. It does not issue invoices or take payments. Work that GSS does for you is quoted and charged under a separate quote or written agreement, which sets the price, payment terms and delivery times. Global Software Services (Pty) Ltd is not registered for VAT, so no VAT is charged.
Nothing is bought through the portal, so the cooling-off right in section 44 of the Electronic Communications and Transactions Act does not apply to it. Your rights on a purchase follow the terms of that purchase and the law.
We aim to answer tickets promptly, but the portal does not promise response or resolution times. Service levels apply only where your written agreement with us sets them.
5. Your account
Keep your password and sign-in codes confidential, and do not share your account. Tell us at once at [email protected] if you think someone else has used it. We recommend that you turn on two-factor authentication.
Keep your details up to date. A client's primary contact may manage which of the client's contacts can use the portal and what they can see.
6. Acceptable use
You agree not to:
- use the portal for any unlawful purpose;
- upload malicious code or harmful, offensive or infringing content;
- try to gain unauthorised access to any part of the portal, or test its security without our written permission;
- share your sign-in details with anyone else;
- upload information you are not allowed to share, or more personal information than a ticket needs, such as identity numbers, bank details or health information.
Each attachment may be up to 10 MB.
7. Your content
You keep ownership of what you upload. You allow us to store, copy and use it to run the portal and to provide our services to you. You confirm that you may share it with us, including any personal information of other people in it.
8. Intellectual property
All content, features and functionality of the portal belong to Global Software Services (Pty) Ltd and are protected by copyright, trade mark and other intellectual property laws. Ownership of work we do for you is set by your agreement with us.
9. Confidentiality
Project information, documents and messages shared through the portal are confidential. You agree not to disclose them to anyone else without the other party's written consent. We keep your information confidential too, except where we share it with the service providers named in our Privacy Policy to run the portal, or where the law requires us to disclose it.
10. Privacy
We process personal information in line with the Protection of Personal Information Act (POPIA), as described in our Privacy Policy. It explains what we collect, why, who we share it with, how long we keep it and your rights.
11. Limitation of liability
The portal is a free support tool, provided as it is available. We take reasonable care to keep it running and secure, but we cannot promise that it will always be available or free of errors. Keep your own copies of important documents.
As far as the law allows, GSS is not liable for indirect, special or consequential loss, such as loss of profit or data, that arises from your use of the portal. This does not limit our liability for loss caused by our gross negligence or wilful misconduct, for anything the Consumer Protection Act does not allow us to exclude, or under a separate written agreement with you.
12. Suspending or closing an account
We may suspend or close an account if it is used in breach of these terms, if it puts the portal or other users at risk, or when the client relationship ends. Unless the matter is urgent, we will tell you first and give you a chance to put it right.
You may close your account at any time by emailing [email protected]. Our Privacy Policy explains what happens to your information afterwards.
13. Changes to the portal and these terms
We may change, add or remove features. If a change takes away something you rely on, we will tell you beforehand where we can.
We may update these terms. Each version is published at /terms with its version number and date. If a change materially affects you, we will tell you by email or in the portal before it takes effect.
14. Governing law and disputes
South African law governs these terms. Please contact us first at [email protected], so that we can try to resolve any complaint.
If you use the portal for a business, you consent under section 45 of the Magistrates' Courts Act 32 of 1944 to the jurisdiction of the Magistrate's Court that has jurisdiction over GSS, even if the amount in dispute is more than that court's usual limit.
If you are a consumer, you keep your right to approach any court with jurisdiction, the National Consumer Commission or the Consumer Goods and Services Ombud (www.cgso.org.za, [email protected]), and, about your personal information, the Information Regulator.
